1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Contractor," "you," or "your") and Harper AI, Inc., a Delaware corporation ("Company," "we," "us," or "our") governing your access to and use of the StormSnipe platform, including our website at stormsnipe.com, storm event lead lists, Strike Map dashboard, subscription services, and all related services (collectively, the "Service").
By accessing or using the Service, creating an account, or purchasing any product, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.
2. Service Description
StormSnipe provides automated severe weather lead intelligence. The Service detects qualifying hail events using publicly available data from the NOAA Severe Weather Data Inventory (SWDI), NWS Alerts API, and related federal datasets, then extracts affected residential addresses from the US National Address Database (NAD) and delivers those addresses to contractors for the purpose of physical door-to-door canvassing.
The Service includes: - Shared Lead Packs: Full storm data (Strike Map + supplementary address CSV) for a storm event. Any number of contractors may purchase the same event and each receives the complete data ($149/event). - Exclusive Territory: Sole access to the Strike Map and address data for 48 hours by trade type (from $299/event). - StormSnipe Pro: Monthly subscription providing auto-delivery, priority delivery, and dashboard access (from $49/month). - Branded Exclusivity: Logo and branding placement on StormSnipe marketing properties (+$299/month). - Media Stream License: HD live weather stream for TV stations and weather networks ($500–$2,000/month).
3. Account Registration
You must create an account to purchase any paid Service. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
You are responsible for safeguarding your account credentials. You must notify us immediately at press@stormsnipe.com if you suspect unauthorized access to your account. StormSnipe is not liable for any loss or damage arising from unauthorized account access resulting from your failure to safeguard your credentials.
You must be at least 18 years old and have the legal authority to bind any business entity on whose behalf you register to these Terms.
4. Acceptable Use
You may use StormSnipe data solely for physical canvassing of storm-damaged properties by licensed contractors. You expressly agree that you will NOT:
(a) Resell, sublicense, redistribute, or share purchased lead lists or address data with any third party, including other contractors, lead aggregators, or data brokers;
(b) Use purchased address data for telemarketing, mass email campaigns, or any form of electronic communication to homeowners;
(c) Automate or scrape any portion of the StormSnipe platform, including the website, Strike Map, or API;
(d) Create multiple accounts to circumvent exclusivity limitations or purchase limits;
(e) Use the Service for any unlawful purpose or in violation of any applicable law or regulation;
(f) Represent StormSnipe data as your own proprietary data;
(g) Use the data to harass, intimidate, or engage in any abusive conduct toward homeowners.
Violation of these restrictions may result in immediate account termination, forfeiture of any paid fees, and civil or criminal liability.
5. Payment Terms
All fees are quoted in US dollars. Payment is processed via Stripe, Inc. By providing payment information, you represent that you are authorized to use the payment method. All sales are final except as described in our Refund Policy.
For monthly subscriptions, you authorize StormSnipe to charge your payment method on a recurring monthly basis on the anniversary of your subscription start date. Subscriptions may be canceled at any time through your account settings; cancellation takes effect at the end of the current billing period.
6. Exclusivity Terms
When you purchase an Exclusive Territory product, StormSnipe agrees not to sell or distribute the same storm event address list to another contractor of the same trade type (e.g., roofing, solar, fencing) within the exclusive territory for a period of 48 hours from the time of your purchase.
The "same trade type" determination is at StormSnipe's sole discretion based on the trade category you selected at registration. Exclusivity does not prevent StormSnipe from selling the same address list to contractors of different trade types (e.g., a roofing exclusive does not prevent a solar company from purchasing a Solar Upsell Pack for the same event).
The exclusive territory is defined as the geographic area described by the NOAA NWS warning polygon for the specific storm event. Territory definitions are non-negotiable and based on government-issued data.
After the 48-hour exclusivity window expires, StormSnipe may include the affected addresses in shared packs or future products without restriction.
7. Data Accuracy Disclaimer
StormSnipe provides address lists based on publicly available federal data sources. The inclusion of any address in a lead list does not constitute a guarantee, representation, or warranty that: - The property sustained actual hail damage; - The property owner is interested in hiring a contractor; - The address information is current, accurate, or deliverable; - Any insurance claim has been or will be filed.
Storm damage leads are probabilistic. Confidence scores reflect radar-derived estimates and spotter report frequency, not definitive physical assessments. StormSnipe is not an insurance company, licensed adjuster, or property inspector. All canvassing and damage assessment decisions remain the sole responsibility of the purchasing contractor.
8. Intellectual Property
All content, features, and functionality of the StormSnipe platform – including but not limited to visual design, software, map visualizations, and proprietary algorithms – are owned by StormSnipe and protected by applicable intellectual property laws. Underlying weather data and government address data are in the public domain.
Your purchase of a lead list grants you a limited, non-exclusive, non-transferable license to use the address data solely for the purpose of physical canvassing in connection with your legitimate contractor business.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HARPER AI, INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST BUSINESS OPPORTUNITIES, OR LOSS OF DATA, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL STORMSNIPE'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE TOTAL AMOUNT PAID BY YOU TO STORMSNIPE IN THE 12 MONTHS PRECEDING THE CLAIM.
Some jurisdictions do not allow certain limitations on liability; if you reside in such a jurisdiction, some of the above limitations may not apply to you.
10. Indemnification
You agree to defend, indemnify, and hold harmless StormSnipe and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your canvassing activities, contractor work, or interactions with homeowners; or (d) any claim that your use of StormSnipe data caused harm to a third party.
11. Termination
StormSnipe may terminate or suspend your account immediately, without prior notice or liability, if you breach these Terms or if we determine, in our sole discretion, that continued access poses a risk to the platform or other users.
Upon termination, your right to access the Service ceases immediately. Provisions of these Terms that by their nature should survive termination (including sections on intellectual property, limitation of liability, indemnification, and governing law) shall survive termination.
12. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the United States. Any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration under the rules of the American Arbitration Association, conducted in English. Class action waivers apply to the extent permitted by law.
13. Changes to Terms
StormSnipe reserves the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website with a new "Last Updated" date. Your continued use of the Service after such notice constitutes acceptance of the updated Terms.
